ICE Deports Illegal Immigrant Convicted of Attempted Murder in France

An illegal immigrant who had been living in New York City was deported after it was discovered he was wanted in France for attempted murder and kidnapping.

Immigration and Customs Enforcement (ICE) agents deported 42-year-old Samba Ndiaye, who went by the name “Mohamed Fall,” last week after he had spent more than a decade in the United States, the agency said in a release.

In Dec. 2002, Ndiaye was convicted of attempted murder, kidnapping, and sequestration with acts of torture, in Marseilles, France. He was sentenced to life in prison but fled the country instead.

“This man was convicted in his home country of the heinous acts of kidnapping and attempted murder, living in our communities as if he was immune from facing his punishment in France,” said ICE official Thomas Decker, in a statement.

In 2005, ICE arrested Ndiaye in New York City, a sanctuary city. At the time, Ndiaye was going by the name “Mohamed Fall,” and claimed to be a citizen of Mauritania, a country in northwestern Africa.

Breitbart News reported that during his deportation process in 2005, Ndiaye was released from custody on bail. In July 2008, an immigration judge ordered that he be deported.

The French national remained in the country until Nov. 2012 when he was convicted for assaulting, resisting, or impeding police officers by an Ohio federal court. After serving eight months in prison, Ndiaye was released to ICE who let him go while the federal agency attempted to his locate his alleged African passport.

Then, in April 2019, ICE officials learned he was actually a French national wanted for multiple violent offenses in his home country. After confirming his identity, Ndiaye was arrested a month later and deported last week via an ICE Air charter flight.

Another Case

Last year, ICE deported another French national after learning that he was also wanted for murder in the country.

According to a European arrest warrant, Fode Youssouf Barro was wanted for being an accomplice in a violent murder involving a hammer, French authorities said.

After the 29-year-old overstayed his visa, ICE’s Enforcement and Removal Operations (ERO) arrested and removed Barro, who was living in New York City, to France, where he will face criminal charges in connection to a 2016 homicide in Troyes.

“This individual sought harbor within our borders while he was wanted to face murder charges in his home country,” said Thomas Decker, field office director for ERO New York. “Barro has now been removed from the United States, solidifying ICE’s commitment to protecting the American public from criminal aliens.”

Since Oct. 2009, ERO has removed more than 1,700 foreign fugitives from the United States who were wanted in their home countries for crimes including kidnapping, rape, and murder. In fiscal year 2016, the agency conducted 240,255 removals across the United States, 92 percent of which had been previously convicted of a criminal offense, according to a release.
