It's the first time a non-sitting president will face such a trial, and some Republicans are arguing against the lawfulness of holding a trial for a former president.

45 Senators have voted that the trial is unconstitutional, so it's unlikely the Senate will impeach Trump. Democrats need at least 17 Republican senators to successfully convict him.
