Two small businesses in California are suing Governor Gavin Newsom over his continuing lockdown orders. The lawsuit claims he doesn’t have the authority to make that decision.

Attorney Luke Wake from Pacific Legal Foundation says, California Constitution is very clear. That legislative power all lawmaking power is is in the legislature's hands. The governor doesn't get to make law but that's effectively what's happening here.

California has a tiered lockdown system. Each of the 58 counties have been designated a tier based on risk level.

California continues to restrict many indoor activities. Wake says, the longer the restrictions remain in place, the more difficult it will be for those businesses to operate or make and make a profit.

Wake says there are some signs California courts are starting to take issue with Newsom’s emergency powers. He has cautious optimism about the case.
