UnitedHealth Group is under investigation by the U.S. Department of Justice (DOJ) over its Medicare billing practices and expanding control of the health care market, raising concerns over potential fraud and anticompetitive behavior.

The DOJ’s health care fraud unit is conducting a criminal probe into how UnitedHealth records patient diagnoses, which can increase Medicare Advantage payments. UnitedHealth Group, the nation’s largest health insurer, said in a statement Thursday that it is cooperating with both criminal and civil requests. “The Company has now begun complying with formal criminal and civil requests from the Department,” UnitedHealth <a href="https://www.unitedhealthgroup.com/newsroom/2025/2025-07-24-uhg-responds-to-doj-investigation.html">said</a>. “The Company has full confidence in its practices and is committed to working cooperatively with the Department throughout this process."

UnitedHealth Group’s insurance division, UnitedHealthcare, covers more than 8 million Medicare Advantage enrollees, and its Medicare and retirement segment brought in $139 billion in revenue last year. Medicare Advantage is a federal program run through private insurers like UnitedHealthcare, which receive taxpayer dollars based on patient risk profiles. Allegations of “upcoding”—where patients are presented as sicker than they are to boost payments—are central to the DOJ’s inquiry, which was reported by The Wall Street Journal in May.

Rep. Pat Ryan (D-N.Y.) has been pressing federal authorities to take action. “United owns the insurance company, they own your doctor, they own the pharmacy and they own the software that processes all of your information,” Ryan <a href="https://patryan.house.gov/media/press-releases/department-justice-investigation-unitedhealth-delayed-staff-reductions">said</a>. “They use it all to keep prices high and drive quality down."

Ryan’s letter to Attorney General Pam Bondi called on the DOJ to prioritize its antitrust investigation into UnitedHealth’s Optum division, which now employs or affiliates with 1 in 10 doctors in the United States. Through acquisitions of practices like CareMount Medical and Crystal Run Healthcare, Optum has gained control of more than 2,500 providers in New York’s Hudson Valley. Constituents report declining care quality, billing errors, and longer wait times since the takeovers.

According to Ryan’s office, Optum’s control of physician services—combined with UnitedHealth’s insurance and pharmacy benefit arms—raises red flags for monopolization. An antitrust investigation into Optum’s acquisitions began in February 2024 but has reportedly been delayed due to DOJ staffing cuts, according to Ryan.

The DOJ has not commented on the timeline or potential outcomes of the investigations. UnitedHealth, meanwhile, says it is conducting third-party reviews to validate its practices.

"To provide our stakeholders transparency and confidence in the Company’s practices, the Company, as previously announced, has proactively launched its own initiative to conduct third party reviews of policies, practices, and associated processes and performance metrics for risk assessment coding, managed care practices, and pharmacy services,” UnitedHealth stated.
