A federal grand jury returned a nine-count indictment on Wednesday against a Chicago man accused of fatally shooting two Israeli Embassy employees outside a Washington museum in May.

Elias Rodriguez, 31, faces federal hate crime charges that could make him eligible for the death penalty if convicted over the May 21 shooting deaths of Yaron Lischinsky, 30, and Sarah Milgrim, 26, according to the indictment. The couple were about to become engaged and worked at the Israeli Embassy in Washington.

The attack occurred outside the Capital Jewish Museum as the victims were leaving an American Jewish Committee event for young diplomats and professionals, according to court <a href="https://storage.courtlistener.com/recap/gov.uscourts.dcd.283512/gov.uscourts.dcd.283512.27.0.pdf">filings</a>. Rodriguez traveled from Chicago to the Washington area the day before the shooting, transporting a 9mm semi-automatic handgun in his luggage, according to the indictment.

Court documents reveal Rodriguez had posted violent anti-Israeli content on social media for months before the attack, with one example being "Happy New Year, Death To Israel,” being posted on Jan. 1, 2024.

In May 2024, he sent a direct message stating "please please please god please vaporize every Israeli 18 and above so these kids have some chance at becoming human," court papers show.

Before carrying out the shooting, Rodriguez authored a document titled "Explication" that argued perpetrators of Israeli military actions in Gaza had "forfeited their humanity," according to the indictment. He scheduled this manifesto to be posted on social media later that evening, court documents state.

The indictment alleges Rodriguez researched the American Jewish Committee's website, which describes the organization as one that "stands up for Israel's right to exist in peace and security." He purchased a ticket to the "Young Diplomats Reception" after reviewing event details online, according to the court filings.

<h2>Around 20 Shots Fired</h2>
Rodriguez fired around 20 shots at the victims as they exited the museum, located about a mile from the White House. During the shooting, he called out "Free Palestine”.

After the attack, Rodriguez entered the museum, where attendees remained inside. He displayed a red keffiyeh and declared, "I did it for Palestine. I did it for Gaza”.

As police removed him from the building, he continued shouting "Free Palestine" and made statements about "intifada," "revolution," and "free Gaza”.

He also yelled at remaining event attendees, "shame on you" and "shame on Zio-Nazi terror”.

The indictment includes charges for murder of a foreign official, since Lischinsky was an Israeli citizen in the United States on official business. Rodriguez also faces two counts of hate crimes resulting in death, two counts of discharging a firearm during a crime of violence resulting in death, and local charges including first-degree murder while armed and assault with intent to kill while armed.

Two other Israeli Embassy employees, identified in court papers only as C.S. and A.T., were present during the shooting but survived.

The federal charges include special findings that make Rodriguez eligible for capital punishment. Such includes that he intentionally killed multiple victims, engaged in substantial planning, and created a grave risk to others beyond the immediate victims.

United States Attorney Jeanine Pirro previously indicated the case would be investigated as a hate crime with potential death penalty implications. The indictment formally establishes the legal framework for capital punishment consideration, citing Rodriguez's age, premeditation, and the targeting of multiple victims.

Rodriguez is scheduled for a court appearance Friday. He has not yet entered a plea to the charges.

The indictment also seeks forfeiture of the weapon used in the attack and any substitute property if the firearm cannot be recovered.
