Texas’s highest criminal court has again stopped the execution of death row inmate Robert Roberson, sending his case back to the trial court in East Texas for renewed scrutiny of the science and evidence used to convict him.

The stay, issued Thursday by the Texas Court of Criminal Appeals, arrives one week before Roberson was set to receive a lethal injection on Oct. 16 for the death of his 2-year-old daughter, Nikki, and is the third time since 2016 that his execution date has been blocked.

The court’s order relies on Texas’s 2013 “junk science” law, which permits relief when evidence used to secure a conviction is later deemed unreliable or outdated. In granting the stay, the appeals court pointed to its October 2024 decision overturning the conviction of Andrew Roark in another so-called "shaken baby" case—a ruling Roberson’s defense team argues is indistinguishable from his own.

Roberson’s lawyers, who have long challenged the medical foundation of the state’s case, welcomed the ruling and highlighted the parallel tracks between Roark’s reversal and Roberson’s conviction.

“We are relieved and grateful that members of the (appeals court) appreciate the parallels between Andrew Roark’s case and Robert Roberson’s,” attorney Gretchen Sween said in a statement. “Robert adored Nikki, whose death was a tragedy, a horror compounded by Robert’s wrongful conviction that devastated his whole family. We are confident that an objective review of the science and medical evidence will show there was no crime.”

The Texas Attorney General’s Office, which is seeking Roberson’s execution, did not immediately respond to a request for comment from NTD News.

Prosecutors told jurors in Roberson’s 2003 trial that he hit and violently shook Nikki, which resulted in fatal head trauma consistent with shaken baby syndrome. Roberson has maintained his innocence for years and, speaking from death row in Livingston, Texas, last week, denied harming his daughter. “I never shook her or hit her,” he said.

Shaken baby syndrome refers to severe brain injury resulting from a child’s head being violently moved or struck, for instance, being slammed against a surface or thrown. While prosecutors and medical societies continue to defend its validity, the diagnosis has faced growing scrutiny from lawyers and medical experts who say it has led to wrongful convictions.

Roberson’s defense now argues that Nikki’s death stemmed from pneumonia-related complications rather than abuse. Their latest appeal, they say, combines new scientific and legal analyses that point toward illness and accident as the cause, not inflicted trauma. The filing also includes a joint statement from 10 independent pathologists asserting that the medical examiner’s autopsy—concluding Nikki died of blunt force head injuries—was “not reliable”.

Beyond the medical disagreements, the defense alleges judicial misconduct, contending the trial judge failed to disclose that he also authorized circumventing Roberson’s parental rights and allowed Nikki’s grandparents to remove her from life support.

State officials and some relatives of Nikki, along with some medical professionals, continue to assert the child died from abuse and that Roberson had a history of hitting her.

In a Sept. 26 opinion piece in The Dallas Morning News, three pediatricians, including two affiliated with Yale School of Medicine, wrote that after reviewing the case, they “are convinced that Nikki was a victim of child abuse”.

Since his first execution date more than nine years ago, Roberson’s legal team has pursued relief across state and federal appeals courts and the U.S. Supreme Court, while also petitioning the Texas Board of Pardons and Paroles and Gov. Greg Abbott to intervene to secure a new trial.

Roberson’s case has drawn an unusual coalition of supporters, including liberal and ultraconservative lawmakers, Texas GOP megadonor and conservative activist Doug Deason, bestselling author John Grisham, and Brian Wharton, the former police detective who helped build the original case.

GOP state Rep. Brian Harrison praised Thursday’s stay. “These brave judges took their duty to seek justice seriously, even in the face of tremendous—and dishonest—political pressure to execute a potentially innocent person, who has never been given a fair trial,” Harrison said in a statement.

Separately, Tennessee has reset its capital punishment calendar, establishing 2026 execution dates for four death row inmates, including the state’s only woman on death row.

Christa Pike, part of a restart of executions after a three-year pause triggered by lethal injection testing failures, is now set to be executed on Sept. 30, 2026.

Officials there faced criticism after an investigation found chemicals in seven executions since 2018 had not undergone complete testing, and recent lawsuits and witness accounts raised concerns over potential suffering during lethal injection.
