The Trump administration asked a federal appeals court to put an emergency hold on a judge's order to require the government to fully fund benefits for the Supplemental Nutrition Assistance Program (SNAP) this month.

The <a href="https://www.documentcloud.org/documents/26219981-emergency-motion-on-snap-benefits/">emergency motion was filed</a> in the U.S. District Court of Appeals on Friday morning.

The administration requested that the appeals court suspend any orders requiring it to spend more money than available in a contingency fund and allow it to continue with planned partial SNAP payments for November instead.

SNAP costs between $8.5 billion and $9 billion each month. The emergency reserve fund contains about $4.6 billion.

The administration said in the court filing that the directive to fund full benefits is unconstitutional.

“This unprecedented injunction makes a mockery of the separation of powers,” the administration wrote in the <a href="https://apnews.com/article/snap-food-government-shutdown-trump-a807e9f0c0a7213e203c074553dc1f9b">court filing</a>. “Courts hold neither the power to appropriate nor the power to spend,” the U.S. Department of Justice wrote in its request to the court.

SNAP, which helps 42 million low-income Americans, has been in legal limbo since funds ran dry on Nov. 1 due to the federal government shutdown.

Two judges ruled last week that the administration could not skip November’s benefits entirely because of the shutdown.

One of those judges, U.S. District Judge John McConnell Jr. in Rhode Island, ordered the full payments on Thursday.

McConnell accused the administration of withholding SNAP for "political reasons" and ordered the U.S. Department of Agriculture to fund the program so Americans can get 100 percent of the benefits.

“The defendants failed to consider the practical consequences associated with this decision to only partially fund SNAP,” McConnell said in his ruling. “They knew that there would be a long delay in paying partial SNAP payments and failed to consider the harms individuals who rely on those benefits would suffer.”

The Trump administration’s move on Friday to appeal the judge’s decision makes it unclear whether ultimately SNAP benefits would be paid out in full on Friday as the judge had ordered.

Wisconsin Gov. Tony Evers confirmed that some SNAP recipients in his state already got their full November payments overnight on Thursday.

“We’ve received confirmation that payments went through, including members reporting they can now see their balances,” according to Britt Cudaback, the governor’s spokesperson.

But across many states, recipients face uncertainty over how much they’ll receive and when.

A U.S. Department of Agriculture spokesperson in a <a href="https://www.reuters.com/legal/government/trump-administration-must-fully-fund-food-aid-benefits-by-friday-us-judge-rules-2025-11-06/">statement</a> said Senate Democrats are to blame for compromising SNAP by voting 14 times against a Republican-backed stopgap funding measure that would end the government shutdown, now the longest in U.S. history.
