Texas Border Enforcement Law Likely to Face Legal and Political Challenges: Analyst Predicts Supreme Court Showdown

Texas is effectively attempting to take greater control of border enforcement, as Gov. Greg Abbott signed a new law Monday criminalizing illegal crossings at the state level.
Meanwhile, negotiations on further funding for border security continue in the U.S. Senate.

NTD spoke to Andrew Arthur, a resident fellow in law and policy at the Center for Immigration Studies, to parse out the legal and political ramifications of the Texas move.

“Texas bears the brunt of the Biden Administration’s border policies,” he said. “The federal government has largely ceded control of the border to cartels on the other side to move migrants and drugs into the United States—that creates a clear and present danger to the State of Texas.”
