U.S. District Judge Tanya Chutkan has paused court proceedings in the election case against former President Donald Trump pending his appeal to dismiss the case entirely on the basis of presidential immunity.

NTD spoke to executive director and general counsel at the Texas Public Policy Foundation and former Texas prosecutor Rob Henneke to discuss the issue.

Mr. Henneke criticized Special Counsel Jack Smith for rushing the case through the courts. “In the filings with the court, he urges the court to act with expediency and says ‘this is urgent,’ but he never says why,” he said. “The reason why is simply because he wants this trial to occur for political purposes” ahead of the 2024 election.
