The Department of Homeland Security (<a href="https://studyinthestates.dhs.gov/2025/08/dhs-posts-notice-of-proposed-rulemaking-establishing-a-fixed-time-period-of-admission-and">DHS</a>) proposed new rules on Wednesday that would eliminate indefinite "duration of status" admissions for international students and exchange visitors.

Under the proposed new rules, new visitors would be given fixed time periods and periodic renewals upon admission to the country. This initiative aims to combat widespread fraud and address national security concerns.

The <a href="https://public-inspection.federalregister.gov/2025-16554.pdf">proposed</a> rule would replace the current system that allows F-1 academic students, J-1 exchange visitors, and I nonimmigrant media representatives to remain in the United States indefinitely as long as they maintain their status. Instead, most would be limited to four-year admission periods, with extensions requiring direct approval from immigration officers.

“Replacing admissions for (duration of status) with admissions for a fixed time period of authorized stay is consistent with most other nonimmigrant classifications, would provide additional protections and oversight of these nonimmigrant classifications and would allow DHS to better evaluate whether these nonimmigrants are maintaining status while temporarily in the United States,” DHS stated in the 160-page proposed rule.

The changes would affect approximately 2.1 million people annually in the F, J, and I nonimmigrant programs combined, according to DHS estimates. In fiscal year 2023 alone, there were over 1.6 million F-1 student admissions.
<h2>'Pay-to-Stay' Fraud Schemes</h2>
The proposed reforms build on years of documented fraud and national security concerns. DHS cited multiple criminal prosecutions since 2008 involving "pay-to-stay" fraud schemes, where school officials falsely reported that F-1 students were maintaining status in exchange for cash payments.

The agency identified over 2,100 aliens who first entered the United States as F-1 students between 2000 and 2010 and remain in active status as of April 2025—some maintaining student status for decades by continuously enrolling in different programs.

National security risks have become more problematic in recent years. DHS highlighted multiple espionage cases involving Chinese nationals who used student visas to steal research and intellectual property, including:
<ul>
 	<li>Ji Chaoqun, a Chinese national who studied electrical engineering at the Illinois Institute of Technology starting in 2013, was sentenced to eight years for spying for China in 2023</li>
 	<li>Zaosong Zheng, stopped at Boston Logan Airport in 2019 with 21 vials of biological material, allegedly stolen from Harvard University.  He later pleaded guilty to making false statements to federal agents</li>
 	<li>Yanqing Ye, charged with visa fraud after falsely identifying as a student while allegedly working as a People's Liberation Army lieutenant</li>
</ul>
NTD's sister media, The Epoch Times, previously reported on the Trump administration's 2020 attempt at similar reforms, which proposed two to four-year limits based on country of origin. Those rules were withdrawn under the Biden administration but have been revived with modifications.

Under the new rule, F-1 students would be admitted for their program length up to four years, plus 30 days for arrival and departure. Students needing more time would file extension applications with U.S. Citizenship and Immigration Services, paying fees and undergoing background checks.

The rule would also:
<ul>
 	<li>Limit English language training students to 24 months total study time</li>
 	<li>Restrict program changes during the first academic year except in special circumstances</li>
 	<li>Require completion of higher education levels before pursuing additional programs</li>
 	<li>Require I non-immigrant media representatives to have admission periods up to 240 days (90 days for most Chinese passport holders)</li>
</ul>
DHS estimates the rule would cost $390.3 million to $392.4 million annually over 10 years when considering both U.S. and non-U.S. parties. Costs include filing fees, processing time, and administrative burdens on schools and program sponsors.

The proposed rule fulfills mandates established after the Sept.11, 2001, terrorist attacks. Homeland Security Presidential Directive-2 specifically called for developing "control mechanisms such as limited duration of student status" and better tracking of foreign students.

The Student and Exchange Visitor Information System (SEVIS) was created in response to these directives, but DHS has argued that the current duration of status framework undermines oversight of such students.

The proposed new rules will undergo a 30-day public comment period before it is finalized. If implemented, it would take effect 60 days after publication in the Federal Register.
