A federal judge has permanently blocked the release of special counsel Jack Smith's report about President Donald Trump's alleged mishandling of classified documents at his Mar-a-Lago estate.

On Monday, U.S. District Judge Aileen Cannon <a href="https://storage.courtlistener.com/recap/gov.uscourts.flsd.648654/gov.uscourts.flsd.648654.779.0.pdf">granted Trump's reques</a>t to keep the report sealed.

The order applies to current and future Justice Department officials.

“Special Counsel Smith, acting without lawful authority, obtained an indictment in this action and initiated proceedings that resulted in a final order of dismissal of all charges,” Cannon wrote. “As a result, the former defendants in this case, like any other defendant in this situation, still enjoy the presumption of innocence held sacrosanct in our constitutional order.”

The same judge in 2024 dismissed the case after concluding that Smith was unlawfully appointed as special counsel.

Cannon noted that special counsels in the past have published final reports at the conclusion of their work, either after choosing not to bring charges in a particular case or “after adjudications of guilt by plea or trial.”

Smith had alleged that Trump stored sensitive documents at his Florida estate after his first term in office and then obstructed efforts by the government to get them back.

Smith produced a two-volume report on the classified documents probe, as well as a separate investigation into Trump’s efforts to challenge the results of the 2020 presidential election after he lost to Joe Biden.

Both investigations led to criminal indictments, but those were later abandoned by Smith’s team after Trump won the November 2024 election.  Sitting presidents cannot face federal prosecution, according to legal opinions long held by the Justice Department.

Attorney General Pam Bondi had already determined that the report would remain sealed because it was a deliberative internal document that is protected by privilege and is confidential.

“The illicit product of an unlawful investigation and prosecution belongs in the dustbin of history,” DOJ prosecutors said in a previous court filing. “The United States will leave it there.”

A First Amendment group and watchdog organization had been pushing for the release of Smith’s report.

Chioma Chukwu, executive director of American Oversight, said in a statement that it will continue to “force” the information “into the open” and defend the public’s access to the report.
