The Supreme Court on Tuesday blocked President Donald Trump's deployment of National Guard troops to Chicago who were intended to protect federal immigration agents.

The justices denied the request by the Department of Justice (DOJ) to lift a judge's Oct. 9 order that blocked the deployment of hundreds of National Guard personnel to the nation's third-largest city. The DOJ had asked the Supreme Court to allow the National Guard deployment to continue in Chicago while litigation played out.

“At this preliminary stage, the government has failed to identify a source of authority that would allow the military to execute the laws in Illinois,” Tuesday’s <a href="https://www.supremecourt.gov/opinions/25pdf/25a443_ba7d.pdf">order stated.</a>

Three justices dissented in the 6-3 decision.

In his <a href="https://www.supremecourt.gov/opinions/25pdf/25a443_ba7d.pdf#page=8">dissent</a>, Justice Samuel Alito, joined by  Justice Clarence Thomas, wrote that “the protection of federal officers from potentially lethal attacks should not be thwarted.” Justice Neil Gorsuch in his <a href="https://www.supremecourt.gov/opinions/25pdf/25a443_ba7d.pdf#page=24">dissent</a> also wrote that he would have granted the government’s request.

Illinois and Chicago sued after the Trump administration federalized 300 Illinois National Guard troops and also ordered Texas National Guard troops into the state, calling the actions unlawful without the approval of the governor.

The case represents a test of Trump’s use of the military on U.S. soil. The National Guard is a state-based militia that answers to state governors except when called into federal service by the commander-in-chief with proper justification under Title 10 statutes.

The president invoked that federal law, which allows a president to deploy state National Guard troops to suppress a rebellion, repel an invasion, or if he is "unable with the regular forces to execute the laws” of the country.

Trump has described Democratic-led cities such as Chicago as lawless, saying they are plagued by crime and violent protests. His administration has argued that troops are necessary to protect federal property and personnel, referring to immigration law enforcement officers who have been enforcing federal law in the city.

Democrats disagree and accuse Trump of abusing his power.

Trump had ordered troops to Chicago and to Portland, Oregon, following earlier National Guard deployments to Los Angeles, Memphis, and Washington as part of his nationwide crackdown on crime and illegal immigration. Officials from Portland and Oregon are pursuing a separate legal challenge to Trump's planned deployment to the state's largest city.

Meanwhile, Louisiana Gov. Jeff Landry <a href="https://x.com/Breaking911/status/2003581710232092876?s=20">announced</a> on Tuesday that National Guard troops will be deployed to New Orleans in a crack down there on crime.

“These citizen soldiers will help ensure safety during the busiest season in the city,” <a href="https://x.com/LAGovJeffLandry/status/2003579009897009641?s=20">Landry wrote on X</a>. “We owe them all a debt of gratitude for their commitment to our State and Nation.”
