Trump Seeks Emergency Freeze in BBC Legal Action

A legal action involving President Donald Trump has asked a Florida court for an emergency stay that would block discovery in a $10 billion defamation lawsuit against the British Broadcasting Corporation (BBC).

The Emergency Motion to Stay Enforcement arises from President Donald J. Trump v. British Broadcasting Corporation and would pause last month's court order requiring the production of corporate tax returns, property deeds, appraisals, licensing agreements, governance files, financial statements, and digital asset histories across some 400 business entities.

The July 27 order, issued by U.S. Magistrate Judge Enjoliqué Lett, requires the production of documents dating back to January 2023 and stems from an episode of the BBC series Panorama called "Trump: A Second Chance?" in which the television network is accused of splicing together two quotes spoken some 55 minutes apart during Trump's Jan. 6, 2021 Ellipse speech.

The underlying lawsuit, filed in the U.S. District Court for the Southern District of Florida, alleges the documentary misled viewers by making it appear as though Trump gave a direct call for violent action while omitting his call for peaceful demonstration.

The trust requested the stay after Trump's attorneys moved to file an amended complaint based on reputational harm rather than financial harm, for which the court has yet to rule.

If the court denies the motion for an emergency stay, the trust would have to answer the information subpoena immediately, beginning August 6, followed by weekly production deadlines.

“Once the Trust were to begin handing those records over to the BBC, that disclosure could not be undone, and the Trust's pending objections could not restore what the BBC will already have seen,” the Aug. 5 motion states.

The trust’s objections include arguments that the BBC already holds public financial disclosures, served the same tax discovery directly on Trump, and that the BBC has improperly expanded discovery beyond general complaint references to Trump’s brand, properties, and businesses.

The BBC’s arguments include that the trust’s fear of public disclosure is unnecessary due to a court protective order that’s already in place and that the documentary aired only in the UK and Trump subsequently won reelection.

Because the production deadline is Aug. 6, the court is expected to address the emergency motion without delay.

Under Federal Rule of Civil Procedure 41, Trump as the plaintiff has the option to voluntarily dismiss his lawsuit with or without prejudice, and if so, the court case would end, and the financial records would likely become moot.
